While off-duty, Officer Hurley had been involved in an altercation. Rather than face a serious confrontation, Officer Hurley went to a nearby house in the Eastlakes area to try to get help. At the home, he spoke to a female whose husband felt that the officer had been pushy. Officer Hurley was asking for help and requesting to use the phone. When he was refused any assistance, Officer Hurley turned and went back towards the disturbance. The male, Jimmy Wayne Brown, followed Officer Hurley out and stabbed him in the back.
Controversy in this stabbing arose when a blood alcohol content of .208 was found in the officer’s bloodstream. Jimmy Wayne Brown was later tried and convicted of second degree murder. He was paroled after serving 4 years in prison.
